Position Details
The University’s General Counsel Office provides advice to Senior Administration and the Board of Governors on a broad range of legal issues including employment law, commercial transactions, contracts, intellectual property, policy, administrative law, human rights, and privacy.

Reporting to the General Counsel, the Legal Counsel performs a high level of professional legal services. The successful candidate will work independently and in a team environment.

This position is designed to furnish a high level and broad range of professional legal service to the University of Lethbridge. It independently conducts legal research, advises Senior Executives on legal matters and handles general legal issues for the University as assigned, and interacts with members of the legal profession and others, as required, to perform their duties and responsibilities. Specific areas of practice include: privacy law, contracting and transactional work, intellectual property, human rights, employment law, administrative law, and other areas as needed.

LEGAL COUNSEL RESPONSIBILITIES

  • Provide legal advice and handle general legal issues for the University as assigned
  • Conduct legal research
  • Review and analyze legal issues and make recommendations on matters referred by General Counsel
  • Draft contracts, inter-institutional agreements, and other legal documents for compliance with applicable laws and University policies
  • Liaise with internal and external stakeholders to negotiate contractual terms with third parties on matters assigned by General Counsel
  • Deliver educational sessions to internal University stakeholders on a variety of legal issues, including legal risk mitigation, compliance with University policies and procedures, compliance with applicable provincial and federal laws and regulations, and other legal topics
  • Review and develop University policies, procedures and guidelines
  • Assist with internal reviews, investigations, and hearings and appeals
  • Coordinate and implement legal projects as assigned for the General Counsel
  • Provide guidance to the Privacy Officer on matters related to privacy/information laws and in particular FOIP (the Freedom of Information and Protection of Privacy Act of Alberta), HIA (the Health Information Act) and PIPEDA (the Personal Information Protection and Electronic Documents Act);

MAJOR DUTIES AND RESPONSIBILITIES

  • Remain current on municipal, provincial and federal legislation, regulations, ordinances and bylaws, in particular pertaining to post-secondary institutions
  • Remain current on and conducts research on administrative tribunal and court decisions
  • Receive and investigate inquiries from University senior administrators on assigned legal matters  
  • Investigate legal issues and makes recommendations on matters referred by General Counsel 
  • Drafts contracts/agreements and other legal documents and policies for compliance with provincial and federal laws, as well as University policies and regulations.
  • Confer with University senior administrators on matters involving legal interpretation and decisions having legal and/or policy implications
  • May serve on University committees as designate of the General Counsel
  • Assist with internal reviews, investigations, and hearings and appeals
  • Perform other related duties incidental to the work described herein
  • Provide guidance and assistance to the Privacy Officer


Position Qualifications
  • A law degree and membership in good standing with the Law Society of Alberta
  • In-house legal counsel experience, preferably in a post-secondary environment, would be an asset
  • A proven track record demonstrating effective leadership ability and project management skills, and an ability to set priorities and manage multiple ongoing projects
  • Demonstrated capability in reviewing and drafting legal documents and agreements
  • Experience in conducting and analyzing legal research
  • Consultation and relationship management skills to provide legal advice and successfully implement policies and best practices
  • Excellent communication skills to listen to and consult with a range of internal and external stakeholders and prepare effective reports and presentations
  • Possess high degree of self-direction and independence
  • Team player with a willingness to pitch in and support colleagues as required
  • Strong analysis and problem solving skills
  • Knowledge of privacy law would be an asset
  • Knowledge of administrative law would be an asset

Starting Salary Range (at 1.0 FTE) $122,308 - $153,863 annually
Full Salary Range (at 1.0 FTE) $122,308 - $185,418 annually (Excluded Professional 2)
